Coal Mining Safety & Compliance

The attorneys at the law firm of Shuman, McCuskey & Slicer, PLLC have an extensive understanding of the mining process and its associated safety regulations.  For the past several decades, we have effectively defended mining companies accused of various MSHA violations and safety oversight regulations throughout West Virginia and Virginia.

Coal Mining Safety Standards

Congress updated the Mine Safety and Health Act of 1977 (MSHA) and also enacted the Mine Improvement and New Emergency Response (MINER) Act of 2006.  These laws, while meant to provide a safer working environment for coal and mineral miners, have greatly increased the administrative tasks of those ultimately responsible for coal mining safety.

At the same time, as coal mining safety standards have become more stringent, personal injury and premises liability claims have become more of a pressing concern for our clients.  In addition, many clients are finding themselves subject to unjust citations or fraudulent workers’ compensation claims.  Our firm provides a strong and vigorous defense against any unfair allegations regarding safety in the mines.

Safeguarding Finances and Public Status

Our dedicated trial lawyers have the knowledge and skill to carefully investigate and defend against questionable coal mining safety violations.  With years of experience representing the industry, we recognize the need to protect a mining company’s operations and reputation.  As a result, our lawyers not only prepare a strong case, but also strive to limit media exposure of any alleged safety violations.
