Attorneys Timothy Linkous and David Butler successfully obtained the dismissal of claims against a dentist for alleged substandard care under the West Virginia Medical Professional Liability Act (“MPLA”). Plaintiff failed to properly and timely comply with the MPLA and its requirement that a notice of claim and screening certificate of merit must be filed before filing a medical professional liability action against a health care provider. As a result, the Court determined that it lacked jurisdiction over the Plaintiff’s claims and dismissed the claims presented against the dentist.
