SMS Attorneys Achieve Dismissal for West Virginia City

Congratulations to Winchester Attorneys Karen McElhinny and Austin Longnecker, who successfully briefed and argued a motion to dismiss on behalf of a West Virginia City which was sued after passing an ordinance which changed the City’s form of governance. A plaintiff filed suit alleging that the City’s transition from a strong-mayor form of governance to a mayor-manager form of governance was in violation of the City’s charter, the West Virginia Constitution, and the West Virginia Code. McElhinny and Longnecker successfully argued that the change was not only constitutional and lawful but was further contemplated by the City’s own charter.
