Shuman McCuskey Slicer PLLC Attorney Obtains Dismissal for Pratt Community Volunteer Fire Department
On March of 2018, Chief Timothy Walker of the Pratt Volunteer Community Fire Department and four other firemen were responding to a motor vehicle accident with multiple fatalities when the fire truck they were in ran off the road and collided with a stone outcrop, causing the death of two firefighters and injuring three others. As a result, Plaintiffs filed two separate wrongful death actions which were later consolidated before Judge Webster. On April 28, 2021, SMS attorney Anthony E. Nortz successfully argued that the Pratt Community Volunteer Fire Department and their former Chief, Timothy Walker were entitled to immunity under the West Virginia Tort Claims and Insurance Reform act which, in part, grants immunity to political subdivisions for injuries which are compensable by workers compensation. On July 20, 2021, Judge Webster entered an Order dismissing Plaintiffs’ claims against the Pratt VFD and Mr. Walker.
