Shuman McCuskey Slicer PLLC Attorney Obtains Favorable Ruling from the Supreme Court of Appeals of West Virginia
Shuman McCuskey Slicer PLLC attorney Michael D. Dunham obtained a favorable ruling from the Supreme Court of Appeals of West Virginia upholding an award of attorney’s fees previously awarded by the circuit court. The plaintiff challenged the decision of the Circuit Court of Morgan County regarding the payment of attorney’s fees. At the Pitrolo hearing in the circuit court, all parties agreed that the plaintiff should be awarded reasonable attorney’s fees based upon a written contract between the parties; however, the parties disagreed as to the reasonableness of the amount in attorney’s fees the plaintiff sought. The circuit court sided with the defendants and awarded the plaintiff approximately 1/3 of the fees originally requested. The plaintiff appealed. The Supreme Court of Appeals for West Virginia affirmed the lower court’s decision. Reasoning that the Circuit Court of Morgan County’s reasoning and conclusions were explained in detail, the Court found that the circuit court did not err in its calculation of the appropriate amount of money to be paid to the plaintiff’s attorney.
