SMS Attorney Michael Dunham Obtains Favorable Verdict
Shuman McCuskey Slicer PLLC member attorney Michael D. Dunham obtained a favorable verdict on behalf of his client, a UIM carrier, in a recent jury trial in Clarke County, Virginia. The plaintiff was involved in a rear end motor vehicle accident causing the plaintiff’s vehicle to roll over. Liability was stipulated, and the only issue for the jury to decide was damages. In addition to a shoulder injury, the plaintiff claimed a traumatic brain injury with ongoing cognitive deficits. The plaintiff called several expert witnesses to support the claims. The defense experts testified that the plaintiff did not suffer a traumatic brain injury in the accident and was not demonstrating cognitive deficits. The plaintiff requested that the jury award him $500,000 plus interest. After deliberations, the jury returned a verdict of $10,000. Because the tortfeasor’s carrier previously settled the case for more than $10,000, Mr. Dunham’s client did not have to pay.
