SMS Attorneys Obtain Multiple Dismissals For Failure to State a Claim

Congratulations to Attorneys Natalie C. Schaefer and Kimberly M. Bandy for obtaining dismissal of their clients for failure to state a claim upon which relief can be granted. Natalie and Kimberly represented high-ranking state officials who were sued as individual supervisors. Several plaintiffs filed lawsuits after allegedly sustaining injuries while incarcerated. Natalie and Kimberly successfully argued that the plaintiffs failed to state a claim for supervisory liability because there lacked any specific allegations against the supervisor clients. The Court agreed and dismissed Natalie and Kimberly’s clients.
