SMS Attorney Michael Dunham Obtains Dismissal Over Lack of Personal Jurisdiction

Congratulations to Attorney Attorney Michael Dunham for obtaining dismissal of his client for lack of personal jurisdiction. Michael represented the operator of a Pennsylvania restaurant and bar. A plaintiff filed a lawsuit after a patron of the restaurant and bar was allegedly overserved and was then in a motor vehicle accident in West Virginia. Michael successfully argued that West Virginia Courts lacked personal jurisdiction over this Pennsylvania business, and that bringing this Pennsylvania establishment into a West Virginia lawsuit would violate West Virginia law, the West Virginia constitution, and the Federal Constitution. The Court agreed and granted the restaurant’s motions, dismissing Michael’s client.
